Job Specifics

Duties Description Under the direction of Deputy Counsel and Associate Counsel, the Senior Attorney will support the Office of Counsel, Bureau of Policy, Regulation, and Legislation. The individual will be primarily responsible for youth related matters including representing the Office in Court and responding to inquiries relating to youth from staff and the field. Additionally, the Bureau of Policy, Regulation, and Legislation oversees the preparation of the agency’s legislative agenda, regulations, and the OMH Official Policy Manual, and is responsible for filing all new OMH regulations in accordance with the requirements of the State Administrative Procedure Act.

Specific duties to be performed may include, but are not limited to, the following:

• Primary duties include serving as point person for program regarding youth matters.
• Appear in court for Youth Matters.
• Conduct all RTF Fair Hearing appeals.
• Review of court documentation.
• Respond to questions from the field or program regarding youth matters.
• Review, draft and edit central office or facility policies.
• Respond to Justice Center related questions.
• As requested by Counsel, draft, review and edit Regulations including SAPA documents. Assist in regulation communications, respond to questions from internal staff and leadership.
• As requested by Counsel, draft, review and edit guidance.
• As requested by Counsel, draft, review and edit legislation. Respond to legislative and programmatic inquiries and requests for bill comments.

Minimum Qualifications Non-Competitive Minimum Qualifications Under the NY HELPS Program:
Admission to the NYS bar and two years of post-licensure professional legal experience.

Transfer:
Candidates must have permanent status as a Senior Attorney and be eligible for lateral transfer; OR be eligible to transfer via Section 70.1 or Section 52.6 of the Civil Service Law by having at least one year of permanent service in a qualifying title within two salary grades or one M-grade of this position.

This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of NY HELPS, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply.

At a future date, it is expected that employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
