Job Specifics

Duties Description Assess the legal sufficiency of applications by local governments for the State Comptroller’s approval of the establishment of town and county special districts (including water and sewer districts), business improvement districts, the issuance of indebtedness by certain local governments located within the Adirondack Park, and exceeding or excluding indebtedness from Constitutional debt limits.
• Undertake review and analysis of documents and information submitted as part of the application including, as appropriate, engineers’ reports, grant agreements, proposed real property tax, assessment and fee rates, bond resolutions, contracts and other materials.
• Apply legal principles of the law pertaining to the Comptroller’s approval functions. Coordinate with the Comptroller’s Division of Local Government and School Accountability (LGSA) and interact with representatives of the applicant-local government.
• Prepare in-house legal opinions and other documents in connection with the approval function.
Provide legal advice to staff of LGSA in connection with audits of local governments, and provide advisory technical assistance to municipal attorneys, certain local government officials, taxpayers and others on various areas of law relating to municipal finances, including real property taxes and assessments. Review and edit informational materials prepared by LGSA staff for posting on OSC website. Review for legal compliance certain documents required submitted for filing with OSC.
• Analyze documents and inquiries to identify legal issues.
• Perform necessary legal research of statutes, case law, legislative history, etc.
• Develop response, including legal rationale; assess propriety of accepting document for filing.
Make presentations at training seminars and webinars for municipal attorneys and other local government officials on special district issues and certain other topics.
• Undertake preparation, including research of the subject area, of outline of written remarks, and preparation of handouts and PowerPoint.
Participate in drafting certain OSC Program Bills and supporting memoranda, and review and comment on pending legislation relating to special district and certain other issues relative to municipal finance.
• Undertake legal research as necessary.
• Prepare proposed bill language and memoranda for review.
• Review and analyze technical issues raised by pending bills.
• Prepare and present comments.
Additional Comments Desired Competencies
1. Admission to the NYS Bar.
2. At least one year experience practicing law in NYS.
3. Fundamental understanding of NYS laws pertaining to municipal finance, including the imposition of taxes and assessments, and borrowing.
4. Fundamental understanding of the structure and function of NYS local governments.
5. Excellent written and oral communication skills.
6. Ability to organize large volumes of factual and legal data into clear and logical sequences.
7. Ability to analyze legal issues and identify significant cases, opinions and facts.
