Job Specifics
Minimum Qualifications This is a competitive position filled from the Civil Service Eligible list for Attorney's. The eligible candidate's profile must match that of the position. This is also a transfer opportunity for current NYS Employees who have one year of permanent or contingent permanent service as a Senior Attorney (Realty) or eligible to transfer from other titles that Civil Service has deemed appropriate.
Duties Description •Studies appropriation maps for accuracy of description and compliance with statutes. Recommends revisions when necessary.
•Examines Report of Physical Inspection for visible objections to title.
•Examines Abstract of Title as to legal sufficiency and devolution encumbrances, if any.
•Inspects Tax Search to determine outstanding tax liens, if any.
•Prepares Report of Title containing all relevant legal information regarding ownership and possible objections to title.
•Prepares initial letter of title certification for State agency involved in real property acquisition.
•Secures affidavits of heirship, agreements not of record, tax payment records and court adjudications.
•Organizes other legal instruments needed to remove objections to title.
•Prepares and maintains a continuation of title certification.
•Composes correspondence to claimants, attorneys, State agencies and other involved parties.
•Prepares final letter of Certification citing all owners of any right, title or interest in the property to be acquired.
•Arranges and transmits necessary closing instruments which may include deeds, affidavits of title, releases of owners, discharge of encumbrances, vouchers and agreements.
•Examines returned closing papers for validity of execution by claimant.
•Drafts certification of payment for transmittal to the State Comptroller’s Office.
•Prepares informal legal opinions on questions involving title and real property.
•Prepares memoranda for the Governor on proposed legislation.
•Assists in the preparation of briefs in litigation involving State’s interest before all courts of the State and its municipalities.
•Assists and counsels personnel of various State agencies involved in the acquisition of real property.
•Acts as counsel in court cases involving real property in which State is a party.
•Conducts legal research in connection with all the above.
•Maintains work records and prepares periodic reports on work progress.
•Supervises and assists title searchers and Assistant Attorneys on staff.
•Performs other duties as assigned.
