Job Specifics
Minimum Qualifications Candidates must have one year of permanent, competitive, or non-competitive 55 b/c service as a Senior Attorney OR be eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law.
Preferred Qualifications: Experience and/or knowledge of Health Law and/or Medicaid Law; and extensive litigation experience in state or federal courts and/or administrative forums preferred. Candidate must have excellent analytical, and writing skills. Candidate should be self-motivated, able to work as part of a team, organized, efficient, and possess good inter-personal skills.
Duties Description The candidate will be responsible for providing support to other Divisions and Offices within the agency in the form of legal advice, review and analysis, as well as conducting general and specific legal research of issues relating to Medicaid. The Senior Attorney in this area will also assist staff at all levels of the agency (i.e. agency program managers and audit and investigation staff), and will advise staff on issues relating to the application of Medicaid laws, rules and regulations and other laws affecting OMIG’s activities, operations and/or overall mission. Matters that an attorney assigned to this area might be asked to work on include, but are not limited to: handling and processing FOIL requests on behalf of the agency, filing judgment liens against providers and working with the Attorney General’s Office to enforce such liens, assisting in identifying liabilities of providers who have filed for Bankruptcy and reviewing notices and other documents produced by agency staff. In addition, this Senior Attorney will advise agency staff regarding legal matters that arise in litigation and will provide assistance to the Attorney General’s Office in such matters including: reviewing court papers, assisting in the drafting of answers, memoranda of law and other responsive documents, responding to discovery requests, obtaining and assisting in the preparation of affidavits and assisting in the development of the OMIG’s legal position and strategy toward the case. The candidate may be asked to provide general legal advice to the agency on a variety of matters related to Medicaid Program Integrity.
