Job Specifics
Minimum Qualifications Applicants must possess a minimum of three (3) years of civil litigation or other directly relevant experience. Strong writing, analytical, and organizational skills are also required. Candidates possessing experience in health advocacy, consumer protection, and/or affirmative litigation and have demonstrated a commitment to public service are strongly encouraged to apply.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The Office of the New York State Attorney General is seeking an experienced attorney to serve in its Health Care Bureau in New York City. The Health Care Bureau seeks to use the law in all its forms to find solutions to health care inequities rooted in historical, persistent, and systemic discrimination. We are looking for an attorney to help grow our health care equity and justice work on behalf of people of color, LGBTQ people, people with disabilities, and low-income women and families, and all those struggling to access affordable, quality health care services.
The Health Care Bureau is committed to protecting consumers from deceptive or illegal practices and ensuring access to health care by bringing civil prosecutions for violations of public health, insurance, civil rights, consumer protection, and other applicable laws. In addition, the Bureau advocates for legislation and policy initiatives to enhance the rights of health care consumers and their ability to access quality, affordable care in New York State. The Bureau has been recognized for its enforcement work during the COVID-19 pandemic in responding to unfair billing practices and fraudulent marketing of treatment and testing products, as well as for its settlements in mental health parity. Furthermore, the Bureau is working to ensure that New Yorkers continue to have access to safe reproductive health care, including abortions, and to curtail misinformation in this area. The Bureau also operates a consumer Helpline, which assists in the resolution of individual consumer complaints regarding their health care plans and coverage.
The selected attorney’s primary responsibilities will be to lead investigations and enforcement actions in furtherance of our mission and may include active tobacco litigation work to hold accountable those responsible for the vaping epidemic in New York and nationally, and for the sale of contraband cigarettes in the state. The Bureau’s cases typically seek injunctive relief, restitution, costs, and penalties.
