Job Specifics
Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.
Duties Description Reporting to Deputy Counsel for Licensing, Regulations, and Compliance, the Associate Counsel for Regulatory Development will serve in the Office of Cannabis Management's Office of General Counsel (OGC) and will be the primary attorney responsible for managing the regulatory portion of the legal portfolio. The Associate Counsel for Regulatory Development will assist all program units with the development of and revisions to regulations developed in furtherance of and in conformance with the Cannabis Law and the policies and programs developed by the Office of Cannabis Management (OCM) and the Cannabis Control Board (Board).
Duties include, but are not limited to:
• Assist OCM’s program units to draft and revise new and existing regulations implementing the Cannabis Law.
• Collaborate with policy staff and other OCM personnel on effective rulemaking, implementation, and related strategies.
• Prepare required documents for filing and implementation of regulations in accordance with the State Administrative Procedure Act.
• Coordinate with the Regulatory Review Unit and the Department of State’s Division of Administrative Regulations to submit and obtain approval for all rulemaking packages timely.
• Prepare documents used to represent the Office of Cannabis Management in litigation and administrative proceedings regarding challenges to the Cannabis Law and regulations.
• Work with the licensing and compliance attorneys and program staff to conduct legal research and prepare formal and informal legal memoranda with opinions, citations, and legal precedents in support of OCM programs as assigned by OGC managers.
• Prepare legal opinions and memoranda for the Office on a variety of legal issues including interpretation of the Cannabis Law rules and regulations.
• Conduct legal research and prepare legal memoranda with opinions and citations regarding the legality of actions taken or to be taken by OCM and the Cannabis Control Board.
• Prepare OCM program bill packages, as requested, including bill summary, text of legislation and supporting memoranda relating to laws affecting the Office.
• Evaluate, comment, and make recommendations on proposed legislative proposals by other agencies, bills presented by the legislature, or proposed legislation presented by the private sector in areas relating to the work of the Office.
• Perform the full range of supervisory responsibilities.
• Other duties as assigned by the General Counsel or First Deputy General Counsel.
Additional Comments NOTE:
• Travel may be required (approximately 5%), including during evening and weekends, depending on mission and assignment.
• Possession and maintenance of a valid Driver’s License issued by the NYS Department of Motor Vehicle is required, or otherwise demonstrate the capacity to meet the transportation needs of the job.
