Job Specifics

Minimum Qualifications This position is non-competitive. Candidates must be admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.

Duties Description Under the general direction of the Deputy Counsel(s), with considerable latitude for independent action, the position includes, but is not limited to, the following duties:

• Act as DLA (Division of Legal Affairs) liaison with the Integrated Eligibility System (IES) Program. Provide legal guidance on security, privacy, confidentiality and compliance build of IES. Coordinate the review of project documentation within DLA;
• Provide support to OTDA officials on questions of law, particularly those involving electronic discovery, document retention and information security, privacy, confidentiality and compliance issues;
• Assist and supervise team in providing legal and technical support for the agency concerning the scope and appropriateness of access to agency systems and data. Oversee team that serves as point of contact for agency and local districts with regard to security incident investigations and/or breaches, liaising with third parties as necessary;
• Assist and supervise team with regard to the development and monitoring of agency compliance with various IT-related policies and tools, including the use of social media, email management, litigation holds, the auditing of systems, and the installation and modification of new IT hardware and software;
• Assist and supervise team in providing legal support with regard to systems and data issues related to disaster preparedness planning and business continuity.;
• Assist and supervise team in the development of responses to external audits, reviews or certifications; assist in providing legal advice to local districts in matters involving security and confidentiality of data and other IT issues; assist in providing legal guidance in matters that are novel or potentially precedent setting;
• Collaborate in the development of presentations relating to data security, privacy, confidentiality and compliance for internal and external groups;
• Assist in liaising with the Office of Information Technology Services and other third parties on legal issues involving information security and confidentiality, data ownership, data classification, data exchange, data loss prevention, information governance, audit and forensic review of data used and/or collected, and IT project prioritization and development; and
• Assist in preparing and reviewing regulations, policy documents, and agreements, as well as other tasks that may be needed.

Additional Comments A full time, permanent appointment will be made. If certified by Civil Service, mandatory reemployment list candidates must be considered first for appointment to this title. Candidates must be legally authorized to work in the United States.
