Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must be admitted to the New York State Bar AND have two years of relevant, post-graduate experience, including significant trial work or administrative hearing experience, demonstrating progressively responsible experience in such areas.
CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education. Salary will be commensurate with education and experience. Occasional same day or overnight State-wide travel will be required (5%). This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period. Filling of this position is contingent upon Division of the Budget approval.
Duties Description The New York State Education Department’s (NYSED) Office of Counsel is seeking applicants for the position of Assistant Counsel. The Assistant Counsel will work on a dynamic team providing legal advice and services to the New York State Board of Regents, the Commissioner of Education, and NYSED staff on a wide variety of issues. Duties of this position include, but are not limited to, the following:
• Provide legal advice and counsel to the Board of Regents, the Commissioner of Education, and NYSED managers on major educational issues affecting the Department and educational institutions throughout the State;
• Perform a variety of legal services, with a minimum of supervision, including legal research, preparing legal briefs/opinions, negotiating and preparing legal documents, and similar functions;
• Serve as one of the legal liaisons to: the Offices of Human Resources Management, Labor Relations and Diversity & Access; Cultural Education (archives, museums, libraries and historical societies); Adult Career and Continuing Education Services-Vocational Rehabilitation, and; Records Access (FOIL).
• Respond to and/or coordinate responses to subpoenas and other requests for sensitive information and documents;
• Provide effective and necessary assistance to the Attorney General (AG) in litigation handled by the AG, and provide effective representation in litigation and administrative proceedings handled by the NYSED’s Office of Counsel;
• Perform research and draft proposed decisions in appeals of actions or decisions of local school district officials brought to the Commissioner of Education for resolution under Education Law §306 and §310 and other related appeal processes, including Freedom of Information Law (FOIL) appeals, and assist in the review of such proposed decisions; and
• Special assignments as requested by the Office of Counsel or NYSED managers.
