Job Specifics
Duties Description The Senior Attorney, NS-M4, will work in the Office of Investigations and Enforcement (OIE) within the Office of General Counsel, performing complex tasks involving large and controversial cases and/or investigations and may also direct or supervise the work of lower-level attorneys. The duties of the position include, but are not limited to:
• Analyzing potential violations of Public Service Law, related to statutes or regulations, and Public Service Commission (Commission) orders and making recommendations related to commencing investigations and/or enforcement actions.
• Conducting research and preparing memoranda on legal issues related to actions of the Commission.
• Advising and updating the functional Department leaders on investigations and cases in their related areas of responsibility.
• Taking sole charge of staff preparation and presentations in all assigned Commission proceedings set for hearings, negotiations, and alternative dispute resolution.
• Analyzing issues, studying the law, and, when appropriate, preparing cross-examination of witnesses in all types of proceedings conducted by and before the Commission, (ranging from simple and routine to extensive and complicated).
• Bringing judicial actions before the courts of New York when requested by the OIE Director, Deputy Director, or General Counsel.
• Drafting orders to carry out all recommendations submitted to the Commission as well as directives promulgated by the Commission.
• Processing, analyzing, and reporting to the Commission on applications on rehearing or reconsideration of its determinations.
• Researching and interpreting complex areas of regulatory law, Commission decisions, and business practices, as well as economic or public policies.
• Appearing for and on behalf of the Commission and the People of the State of New York (utility consumers) in administrative and legal proceedings pertaining to interstate natural gas, electric, and telephone services before various State and/or Federal regulatory agencies.
• Working with other functions at the request of the OIE Director, Deputy Director, or General Counsel on a variety of internal Department compliance matters, audits and reviews, and required action items.

Minimum Qualifications Candidates must have a law degree and five years of experience as a litigation attorney and/or government prosecutor, preferably in the energy, regulatory, telecommunications, or water sectors. Candidates must possess and demonstrate strong research, writing, and oral advocacy skills. Experience in administrative hearings or as a judicial law clerk is preferred.
Must be admitted to the New York State Bar

Remarks:
Salary will be commensurate with experience. The primary location for this position is Albany, NY with up to 15% travel, which requires possession of a valid driver’s license. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority. Appointment to this position is contingent upon Division of Budget approval and completion of a background check.
