Job Specifics

Duties Description The Hearing Examiner will conduct administrative hearings and write decisions in cases involving the professions and occupations regulated by the NYS Department of State. The areas of jurisdiction include but not limited to real estate brokers/salespersons, cosmetologists, appearance enhancement business owners, notaries public, security guards and private investigators. The Hearing Examiner duties in Office of Administrative Hearings will include but are not limited to the following:
• Directly supervise work of Administrative Law Judges and support staff.
o Assign cases to administrative law judges. Monitor OAH calendar to ensure hearings are conducted in a timely manner.
o Review work products to check for quality, accuracy, timeliness and completeness, and make edits or revisions, as necessary.
o Establish work procedures and keep track of daily work; Review and approve time and attendance, and telecommuting workplans.
o Monitors and evaluate staff performance and provide feedback.
o Track progress and execution of assignments.
o Monitor and evaluate performance.
• Review and monitor hearings and decisions of all assigned staff members for legal sufficiency and adherence to agency policy and procedures.
• Oversee the development of the official case record through a formal, litigated process; administer oaths; issue subpoenas, as needed; rule on the admissibility of evidence, question witnesses when required; rule on motions; structure hearing presentations; maintain order, decorum and efficiency as a court record.
• Research the record, briefs, and the law to analyze legal issues and complex legal matters; evaluate evidence; make findings of fact and conclusions of law; peer review of decisions for legal sufficiency and adherence to agency policy and procedures.
• Upon conclusion of administrative proceedings, render final decisions for the NYS Department of State.
• Keep current on rules and regulations, changes to the law, administrative directives, etc.
• Perform other administrative duties as assigned.

Minimum Qualifications Minimum Qualifications
A law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar Association. Six years of subsequent specialized experience as an Administrative Law Judge. Three years must have been at a supervisory level; or one year of the experience must have been at a managerial level.

Education/Experience Substitutions
• Education: Four years of specialized experience; Associate’s degree and two years of specialized experience
• Experience: J.D. or Master’s degree may substitute for one year of specialized experience; Ph.D. may substitute for two years of specialized experience

PREFERRED QUALIFICATIONS:
• Regulatory law experience, including experience with administrative hearings or litigation.
• Analyzing legal issues.
• Researching and interpreting complex areas of law.
• Strong oral and written communication skills.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
