Labor Law section 194-a restricts an employer’s use of wage or salary history. Among these are a ban on their use in making an offer of employment or setting wages for such position, requesting or requiring the submission of wage or salary history or refusing to interview, hire, promote or otherwise employ an individual based on wage or salary history or because an individual did not provide such wage or salary history. An individual is free to use their wage or salary history for the purpose of negotiating a higher salary. For more information on Labor Law section 194-a, please click here.
