REASSIGNMENT QUALIFICATIONS: Current New York State Department of Labor employee with one year or more of permanent, contingent-permanent or 55 b/c service as an Associate Attorney, if you have less than one year, you must be reachable on the current Associate Attorney eligible list for this location, if one exists.
52.7 Non-Competitive Promotion (NCP) Qualifications: To be eligible for NCP, candidates must be in the Department of Labor promotion field and have one year or more of permanent, contingent-permanent or 55 b/c service as a Senior Attorney. If 3 or fewer qualified Department of Labor Senior Attorney respond to this posting, Civil Service may approve the permanent appointment of one of the qualified Senior Attorney without further examination.
52.6 TRANSFER QUALIFICATIONS: One-year of permanent, contingent-permanent, or 55 b/c service in a title Grade 27/M-2 or higher determined to be administrative by Civil Service. Transfer candidates must also possess a law degree from an accredited college or university and be able to provide evidence of current registration to practice law in New York State.

Duties Description Under the supervision of the Supervising Counsel, the Associate Attorney will handle legislative implementation and the development and review of regulatory activity, as well as other assignments. The Associate Attorney will provide legal advice and legal services on matters that are novel, sensitive, or potentially precedent setting; regularly serve as a legal advisor to program administrators and managers; proactively execute assignments; and may supervise less experienced attorneys. The Associate Attorney will be expected to work collaboratively to analyze and interpret new legislative initiatives. In addition to managing assigned cases and matters, the Associate Attorney will also be asked to collaborate with lead attorneys in an advisor or second-chair capacity as needed.
Specific duties include, but are not limited to:
• Analyze, draft, and interpret legislation and regulations as assigned, and communicate with stakeholders both internally and externally regarding the same;
• Work directly with Program staff to implement legislative and regulatory initiatives to ensure compliance;
• Provide advice and counsel to the Department on compliance with various laws and regulations, including but not limited to the State Administrative Procedure Act;
• Review existing regulations to determine if regulations need to be updated to comply with state or federal law, or to conform to changes in the Department’s practices or policies;
• Review both Counsel’s Office and Department processes and procedures to improve efficiencies, identify training needs, and develop and implement long-term strategic planning goals;
• Serve as a confidential adviser to the General Counsel and Deputy General Counsels on various legal matters and special assignments, such as matters where legal precedent is unclear;
• Respond to inquiries and requests for information, legal opinions, and legal interpretations from the General Counsel, Deputy General Counsels, Principal Attorney(s), Supervising Attorney(s), and Program staff;
• Provide clear written and oral communications of legal conclusions;
• Act as the liaison between the Department and the Attorney General’s Office in the defense and prosecution of litigation to which the Department is a party; and
• Perform other duties necessary for the proper and efficient operation of Counsel’s Office.
Additional Comments Position specific job duties may include occasional altered work schedule or job assignments which require availability and willingness to work occasional evenings and/or out-stationed assignments.
