Minimum Qualifications One year of permanent service as a Legal Assistant 1, Salary Grade 14,
OR
A degree or certificate in a paralegal or legal assistant program from a regionally accredited college or university or one approved by the American Bar Association.
Note: Preference may be given to candidates with paralegal or records management experience.
Duties Description Accept service of litigation served upon NYSP employees and the agency. Review legal papers to ensure that service has been properly made. Contact legal offices to advise of improper service.
Create electronic files for all litigation served on members, the NYSP, and non-NYSP cases that are investigated by NYSP personnel.
Maintain extensive electronic litigation database, including updating files to reflect current case status.
Produce monthly litigation report for Superintendent containing comprehensive information regarding current status of cases.
Create/Run database queries/reports to pull statistical information from database. Regularly provide attorneys with a status report of their assigned cases.
Notify the Professional Standards Bureau regarding new litigation. Search PSB database for records relating to litigation.
Ensure OAG litigation hold requests are sent to Troops and other Division installations to secure records necessary for the defense of cases.
Collect and review records sent in response to litigation hold requests. Secure additional records, including Body Worn Camera video footage, as necessary. Coordinate with Troop personnel regularly to ensure all pertinent records are gathered. Forward records to OAG. Redact information using Adobe Pro.
Prepare representation letters for members and the agency, which are sent to the OAG to ensure timely responses to litigation.
Assist and coordinate with the Attorney General’s Office, including OAG investigators and Assistant Attorneys General, regarding the scheduling of members for appearances at pre-trial proceedings and trials. Coordinate with members and their supervisors regarding their appearances at trials/depositions.
Assist attorneys as necessary with preparing responses to discovery requests, including gathering pertinent State Police policies and Academy training materials.
Maintain calendar of upcoming trials and settlement conferences.
Prepare correspondence & materials necessary for settlement of cases.
Upon request from Attorney General’s Office, prepare Section 63(3) letters for Superintendent’s signature.
Review closed litigation files to ensure all pleadings, court decisions, and/or settlement paperwork are contained therein. Maintain records of archived litigation located and the Records Center. Identify which files can be destroyed when they have reached maximum retention time.
Assist with responses to subpoenas and preparation of NODs/Charges filed against personnel, as necessary.
Perform office support tasks, including answering/directing incoming calls to appropriate personnel; opening/sorting/directing incoming correspondence to appropriate personnel in a timely manner; securing office supplies and equipment; and arranging for service of office equipment.
