Duties Description The senior attorney will process cases of possible harassment of rent regulated tenants by their landlords. The attorney will investigate such matters by reviewing submissions from parties and performing necessary research on a variety of databases. Attorney will then conduct informal investigatory conferences at which the owner(s), tenant(s) and witnesses appear and provide further information necessary to investigate the claimed harassment. The attorney will also attempt to mediate all issues between the parties at such conferences. Thereafter, the attorney will be responsible for drafting a follow-up summary letter to the parties and performing follow-up work, including further research, review of documents and facilitation of agreements made at the conference. Where actionable harassment is found, the attorney will recommend the matter for formal prosecution. If approved, the attorney will issue a Notice of Hearing and handle all phases of administrative litigation of the harassment case before an impartial hearing officer, including negotiating settlements, and conducting a full evidentiary hearing.
The attorney will also process non-compliance cases where an owner has failed to comply with agency orders directing, among other things, the restoration of services, renewal of leases or registration of rent regulated premises. The attorney will review the noncompliance file, issue a Notice of Hearing and handle all phases of administrative litigation of the noncompliance case before an impartial hearing officer, including negotiating settlements, and conducting a full evidentiary hearing.
Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply.
At a future date, it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
NON-COMPETITIVE MINIMUM QUALIFICATIONS:
Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.
COMPETITIVE MINIMUM QUALIFICATIONS:
Must be reachable on the appropriate New York State Civil Service eligible list.
70.1/52.6 TRANSFER QUALIFICATIONS:
One year of permanent or contingent permanent in an eligible title for transfer determined to be similar by Civil Service. For transfers, a list of approved titles is available through Civil Service GOT-IT at https://careermobilityoffice.cs.ny.gov/cmo/gotit/. The GOT-IT site will inform you if your title is transferrable.

PLEASE NOTE: Candidates who are brand new to state service will start at the hiring rate of the position which is $93,530 plus location pay of $3,400.
