Duties Description The Senior Attorney position within the Office of General Counsel will be tasked with assisting the Disability Benefits and Paid Family Leave program, including review and editing or publications in support of these programs; monitoring, analysis and implementation of legislation: assisting with policy development, including regulation drafting and support for implementation; assisting with appellate court monitoring of motions to extend and settling records for appellate review; and legal support for Board initiatives, Full Board Review, Freedom of Information Law (FOIL) requests and research projects. Duties will include, but are not limited to, the following:
• Assist General Counsel and Deputy General Counsel with the Disability Benefits and Paid Family Leave program, including drafting and editing regulations; legal research; participating in work groups related to business process and implementation; design and analysis of data related to Paid Family Leave; and reviewing and editing of any publications to be issued in support of these programs.
• Review data and prepare reports for executive staff, and the Governor's office, when requested.
• Assist General Counsel and Deputy General Counsel in research and monitoring of the Legislative program for any bills that may impact the Board or that may be of interest to the Board. Review legislative proposals which have been delivered to the Governor, and draft a letter which conveys the Board's position on that bill before he approves and signs.
• Assist General Counsel with preparation and development of any rules and regulations needed to implement new laws passed by the legislature, and on an ongoing basis, review of all rules
and regulations affecting the various programs of the Board to ensure there are no legal errors
or inaccuracies
• Review and monitor motions to extend the time to perfect appeals to the Appellate Division and by proposed decision for the Board, settle the records for appellate review submitted by parties to appeals.
• Conduct legal research and prepare opinions, memoranda, briefs, and legal papers in response to issues regarding the Workers· Compensation Law from the Chair, the Board, General Counsel, other departments within the Board, or other outside agencies, and be prepared to defend them as needed.
• Respond to a variety of complex legal questions via telephone or written correspondence from all departments of the Board, other governmental agencies, claimants, members of the Bar and the general public in relation to Paid Family Leave or Workers' Compensation Law issues.
• Draft detailed and legally accurate memoranda of law articulating the issues raised on appeal. Make recommendations on modification or rescission of subject MOD or recommend denial of FBR and submit to the appropriate person for review.
• Track the progression of cases on appeal, making note or motions, records and briefs. Work with the Attorney General's office on any appeals related matters, responding promptly to any issued raised. Inform Deputy Counsel immediately of any sensitive issues which may affect or impact the operations of the Board. Upon request, prepare decisions settling the record.
• Prepare for and give presentations and Continuing Legal Education lectures as assigned.
• Participate in special legal/research projects regarding rules and regulations, legislation, FOIL and other special assignments at the request of General Counsel or other supervisors, including such things as legal correspondence, procedures, subject numbers, bills, forms and charts.
• Upon direction of General Counsel, based upon the professional needs of the Board, serve as Senior Attorney in other legal functions within the Office of General Counsel or Adjudication.
Minimum Qualifications Candidates must be reachable on the appropriate Civil Service eligible list.

This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).
For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making permanent non-competitive appointments and the official probationary period will begin.
At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
Position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.
NON COMPETITIVE MINIMUM QUALIFICATIONS
Assistant Attorney 1- Starting Salary $65,001- Must be Law school graduation and/or eligibility for NYS Bar Admission
Assistant Attorney 2- Starting Salary $72,032- Admission to NYS Bar
Assistant Attorney 3- Starting Salary $79,928- 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience
Sr. Attorney- Starting Salary $93,530- 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.
55 B/C QUALIFICATIONS:
Individuals certified eligible for the 55b/c program under the Governor’s Program to Hire Persons/Veterans with Disabilities pursuant to Section 55b/c of the Civil Service Law will also be considered. To be considered, you must meet the minimum qualifications and provide a copy of your letter of eligibility with your response. Candidates must meet the non-competitive minimum qualifications listed above.
TRANSFER QUALIFICATIONS:
Candidates must have one year of permanent competitive or 55 b/c service in a title designated as appropriate for transfer in accordance with Section 52.6, 70.1 OR 70.4 of the Civil Service law.
70.4 transfer candidates must have one year of permanent competitive service in a position allocated to a SG-16 or higher and possess a bachelor’s degree and have standing on the Legal Specialties exam list.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
