Duties Description This position will be located within the Division of Materials Management, Bureau of Waste Reduction and Recycling, Product Stewardship and Extended Producer Responsibility Section. The incumbent will be responsible for providing critical support for the successful implementation of the state’s high-profile product stewardship and extended producer responsibility programs.
More specific duties will include:

•Program management of the NYS Rechargeable Battery Recycling Law and management of a team of EPS1’s in conducting all aspects of the program. Specific activities include, but are not limited to, providing a thorough review of program plans submitted by producer responsibility organizations (PRO(s)), ensuring the PRO(s) continuously meet the minimum convenience criteria and public education requirements set in statute, review of annual reports, provision of stakeholder guidance, preparation of compliance and enforcement documents in coordination with the Office of General Counsel, monitoring regional inspections, drafting of potential regulations.

•Serving as the lead staff person responsible for the administration of the state’s Lead-acid Battery Recycling Law. Duties will include the provision of information and technical guidance to the regulated community.

•Serving as the Division’s primary point of contact in assisting impacted stakeholders with e-cigarette and vaping device voluntary collection opportunities. Should EPR progress in the state for this product category as anticipated, this position will manage the mandatory program as well.

•Assisting in the oversight and administration of NYS's comprehensive Electronic Equipment Recycling and Reuse Act. Responsibilities include, but are not limited to, the detailed review of all aspects of electronic equipment manufacturers’ and collectives’ e-waste acceptance programs for compliance with the Act, review and approval of regulated entity online registrations and annual reports, provision of stakeholder guidance, implementation of Part 368 regulations, calculation of statewide goals, acceptance standards, and surcharges, modification of the programs online data management system as needed, and working closely with the Department’s legal counsel to identify non-compliance and prepare enforcement documents as necessary. This position will be directly responsible for managing registered entities in Regions 1 and 2.

•Monitoring and providing technical assistance via the section’s shared mailboxes (i.e., PSWR, ReTRAC, Part368Regulations and Ewaste) and via telephone, as well as provide guidance to the section’s EPS1’s in their provision of technical assistance to the public. This requires the interpretation of statute/regulations, the relaying of technical information in a clear manner to junior EPS1 section staff, the regulated community and public.

•Reviewing and commenting on proposed product stewardship and extended producer responsibility legislation for potential future state programs (e.g., packaging and paper products, mattresses, solar panels, HHW, batteries, vaping devices, etc.) and assistance with the development and implementation of new programs if/when legislation passes, will also be required.

•Monitoring national activities related to packaging extended producer responsibility programs and will be relied upon to advance the implementation of this program should it inevitably pass in this state.

•Promoting product stewardship and extended producer responsibility across the state through active participation in various environmental organizations, such as the Product Stewardship Institute and the Electronics Recycling Coordination Clearinghouse.

•Supervising and managing all the personnel requirements for two EPS1s in the Product Stewardship and Extended Producer Responsibility Section.

Minimum Qualifications Reassignment - Currently in the title and an employee of DEC

Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.

or

Transfer Eligible: One year of permanent competitive service at Salary Grade 21 or higher and:

Eligible for transfer under Section 70.1: One year of permanent competitive service as a Climate Policy Analyst 2, Environmental Analyst 2, Environmental Radiation Specialist 2, Environmental Specialist 2, Forester 2, Public Participation Specialist 2, Public Participation Specialist 3, Sanitary Construction Inspector 3.
