Duties Description The New York State Education Department (NYSED) is seeking candidates for an Associate Director, Human Resources 2 (Labor Relations) position in the Office of Human Resources Management (OHRM). Under the direction of the Director of Human Resources, the incumbent of this position will provide oversight of planning, development, and direction of the Bureau of Labor Relations within the Office of Human Resources Management. Major areas of responsibility are grievance and disciplinary administration, labor management, and employee relations activities. Duties of this position include, but are not limited to, the following:

• Administer and implement applicable collective bargaining agreements. Research contractual issues and provide technical advice to NYSED directors and program managers on complex technical issues;
• Administer the agency grievance program and protocol, and process complex grievance issues. Ensure that matters are resolved within the applicable statutory and contractual timeframes, and that decisions are complete and accurate. Ensure and that grievance decisions are satisfactorily resolved, and that agency determinations are upheld;
• Participate in all statewide labor/management committees, health and safety committees, other joint labor/management projects and work groups;
• Provide technical assistance to program managers and supervisors in disciplinary matters. Direct investigations and interrogations and make recommendations for appropriate action. Review and issue written communications/documents, including notices of discipline. Represent Department management in high-level agency level reviews and hearings;
• Conduct sensitive and complex disciplinary investigations/arbitrations or Section 75 hearings. Prepare witnesses for both direct and cross examination, prepare and present opening statements, facilitate witness testimony, prepare/examine case evidence and theory, and respond to motions. Deliver closing arguments or prepare written briefs summarizing major points of agency’s case. Negotiate settlements where appropriate;
• Provide guidance and oversight on investigations in which physical assault or neglect has been alleged, including cases referred by the Justice Center for the Protection of People with Special Needs. Serve as primary agency liaison to the Justice Center;
• Provide guidance and oversight on investigations in which harassment has been alleged and report findings to agency management;
• Assess labor relations training needs and develop training and supporting materials and curricula. Deliver training to supervisors of all levels regarding effective labor relations practices, NYS labor contracts, collective bargaining, employee discipline, and related topics;
• Evaluate agency policies and procedures to assess their impact on the agency labor relations program, and recommend revisions or new policies;
• Supervise and assign the work of the Bureau of Labor Relations, monitor and review completed work, and serve as a mentor and trainer to subordinate professional staff;
• Assist the Office of Employee Relations (OER) in presenting the State’s case at improper practice hearings before the Public Employment Relations Board (PERB);
• Establish effective working relationships with union personnel to resolve sensitive or complex problems;
• Facilitate and mediate the conflict resolution process and develop resolution agreements.
• Assist Counsel’s Office at hearings involving NYSED staff pursuant to the NYS Human Rights Law and participate in investigation meetings conducted by the NYS Division of Human Rights, as assigned; and
• Perform other duties as assigned.

Minimum Qualifications MINIMUM QUALIFICATIONS:

Section 52.6 Transfer: Candidates must have one year of permanent competitive or 55b/c service in a title allocated M-1/SG-25 or higher eligible to transfer under Section 52.6 of the Civil Service Law. Provisional Appointment: In the absence of an eligible list with three or more candidates willing to accept a position, a non-permanent provisional appointment may be considered. For non-permanent provisional appointment, candidates must have one year of permanent competitive or 55b/c service as a Human Resources Specialist 3 (Labor Relations) or two years of permanent competitive of 55b/c service as a Human Resources Specialist 2 (Labor Relations). Provisional candidates must take the examination for Associate Director, Human Resources 2 (Labor Relations) when it is next offered and must be reachable on the resulting eligible list to maintain employment.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent competitive or non-permanent provisional appointment. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period and is granted at the discretion of the supervisor and the appointing office. This position will require 25% in-state travel

*Leads to a maximum salary of $127,474 based on annual performance advances.
