Duties Description The Associate Attorney duties in the Office of General Counsel will include but are not limited to the following:
• Prepares all legal updates for and advises the Secretary of State or designee at meetings of the Code Council to ensure legal compliance for all Code Council actions, including but not limited to compliance with Energy Law Article 11, Executive Law Article 18, the Open Meetings Law, SEQRA, and SAPA.
• Supervises the provision of legal services to management and staff of DSBC on a full spectrum of matters related to administration of the Uniform Fire Prevention and Building Code (Uniform Code) and State Energy Conservation Construction Code (Energy Code), including code development, rulemaking, direct code enforcement, training, technical assistance, variances and appeals, oversight, and administration.
• Reviews preparation of Technical Bulletins and formal Uniform Code Interpretations. Oversees and helps prepare rule making documents required for periodic amendments to and updates of the Uniform Code, the Energy Code, DOS regulations relating to administration and enforcement of the Uniform Code and Energy Code, Manufactured Homes, and other regulations.
• Supervises all legal staff working on Codes-related matters including senior attorneys, legal interns and Empire or Excelsior Fellows, which includes but is not limited to preparing performance plans, providing related constructive feedback, and conducting performance reviews.
• Evaluates all phases of work of the Regional Boards of Review, attends meetings of the Regional Boards of Review where necessary, and assists them in drafting decisions in complex matters or when otherwise requested.
• Provides legal assistance and advice to DSBC relating to applications for variances from the Energy Code.
• Supervises the provision of legal assistance and advice relating to direct enforcement of the Uniform Code and Energy Code in counties and local governments where the Department of State is the authority having jurisdiction to administer and enforce the code.
Minimum Qualifications 52.6 TRANSFER QUALIFICATIONS:
One year of permanent, contingent permanent, or 55 B/C service allocated to a Grade 27/M-2 or higher eligible for transfer and determined to be administrative by Civil Service.
Some titles eligible for transfer require special qualifications. For transfers, a list of approved titles is available through Civil Service GOT-IT at https://careermobilityoffice.cs.ny.gov/cmo/gotit/. The GOT-IT site will inform you if your title requires special qualifications for 52.6 or 70.1 transfer as detailed above.
55 B/C Appointment:
This position is eligible for 55B/C designation and candidates with 55B/C eligibility are encouraged to apply. Candidates must meet any open competitive minimum qualifications and must submit their current 55B/C eligibility letter along with their application.
PREFERRED QUALIFICATIONS:
• Legal practice experience in municipal law.
• Legal practice experience in code enforcement matters.
• Two years of litigation experience.
• Legal experience as counsel advising public bodies.
• Rulemaking experience.
• Legislative drafting experience.

Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
