Duties Description The New York State Office of Mental Health (OMH) is recruiting to fill an Associate Director Human Resources 3 (Labor Relations), M-3, position in the Center for State and Community Workforce Development and Human Resources, Bureau of Employee Relations. Under the supervision of the Associate Director Human Resources 4 (Labor Relations), the incumbent will function as both an Assistant Director of the Bureau, supervising a unit of Human Resources Specialists who provide a full range of human resource services to OMH facilities, and as the OMH legal expert on health and safety related issues. Specific duties to be performed may include, but are not limited to, the following:
Serve as the Management Chair of the OMH Multi-Union Health and Safety Committee. Interact with PEF, CSEA, NYSCOPBA and Council 82 representatives and health and safety experts around issues of concern or information. Represent NYS and OMH policy positions and values. Coordinate and conduct quarterly and ad hoc meetings and manage interim issues, communications, and requests for data. Coordinate and involve OMH management committee members and subject matter experts as needed. Consult with the Office of Employee Relations as appropriate. Ensure OMH facilities are informed and aligned.
Serve as the OMH Management Chair of the PEF Labor/Management Committee. Act as the primary OMH point-of-contact for PEF around issues of concern or information. Represent NYS and OMH policy positions and values. Coordinate and conduct quarterly and ad hoc meetings and manage interim issues, communications and requests for data. Coordinate and involve OMH management committee members and subject matter experts as needed. Consult with the Office of Employee Relations as appropriate. Ensure OMH facilities are informed and aligned. Liaison with CSEA, PEF, and NYSCOPBA, including all sub-committees.
Supervise assigned HR Specialist 3 (LR) staff. Assign and monitor disciplinary cases and grievances and ensure that their assigned facilities are managing labor/relations appropriately and are receiving an appropriate level of service and oversight from their assigned BER liaisons. Ensure subordinate staff are trained, supported, and appropriately resourced. Guide and assist them as appropriate. Provide managerial oversight of the Bureau in the absence of the Director.
Promote consistent agency-wide application of union contract provisions to ensure fairness to employees, management and the unions.
Communicate agency and bureau policies, programs and procedures to field staff and the management of Central Office and the facilities.
Offer expert advice and strategies to the Bureau Director concerning statewide policy making issues designed to improve and strengthen the Agency’s employee relations program.
Provide direction to Central Office and facility managers in the conduct of interrogations and investigations leading to disciplinary action. Provide expert advice and assistance to subordinate staff and facility managers throughout the discipline and arbitration process. May sit first or second chair on arbitrations. Review and approve briefs prepared by subordinate staff to summarize the State’s position as part of the arbitration process.
Represent OMH at PERB for improper practice charge conferences and hearings.
Represent OMH in the contract grievance and arbitration process with OER.
Provide employee relations training to facility human resource managers, first line supervisors and OMH Central Office staff.
Apply labor relations expertise to the implementation of new programs.
Identify Agency proposals regarding mandatory and non-mandatory subjects of negotiation.
Specific health and safety legal expert duties include, but are not limited to, the following:
Support the OMH Bureau of Occupational Safety, Health, and Injury Prevention and facility management to represent OMH in DOL/PESH investigations and responses.
o Act as the OMH legal liaison with DOL Counsel’s Office and PESH attorneys. Participate in opening/closing conferences where PESH attorneys are involved when possible.
o Take lead on legal matters arising during opening conferences and mid-investigation issues.
o Research and advise throughout investigation process.
Support the OMH Bureau of Occupational Safety, Health, and Injury Prevention and facility management to represent OMH in the DOL/PESH post-citation appeals process.
o Represent facilities at post-citation informal conferences, where DOL attorneys are involved.
o Draft and file formal appeals.
o Take the lead in litigation, motion practice, and settlement negotiations (administrative law process, Industrial Board of Appeals.)
Manage the OMH relationship with DOL Counsel’s Office and PESH attorneys.
o Engage in frequent discussions with DOL Counsels’ Office on investigation scope, emergent issues, inter-agency relationship, etc.
o Engage in neutral negotiations, separate from OMH’s Bureau of Occupational Safety, Health, and Injury Prevention managers and the PESH inspectors, to mediate and resolve disputes and foster a productive working relationship focused on shared values and objectives.
Conduct legal research on various Safety Initiatives and ensure OMH/NYS interests are protected/represented.
o Research statutes, regulations, and policies around potential policy changes or adoption of new policies under consideration. Identify potential legal pitfalls and assess how best to overcome any related barriers. Consult with the Office of Employee Relations as appropriate.
o Engage with subject matter experts and stakeholders to consider their input and insight.
o Advise OMH executive policy makers on health and safety related policy decisions.
o Draft proposed policy/regulation changes in conjunction with Counsel’s Office; represent the Bureau of Occupational Safety, Health, and Injury Prevention in the regulation change process, for example presenting the proposal to the regulation review committee.
o Assist in the development of formal responses to public comment periods for new and updated Department of Labor regulations.
Support the Bureau of Occupational Safety, Health, and Injury Prevention in the ongoing collection and review of data (Accident Reporting System, NYSIF, etc.) Interact with NYSIF Counsel around requests for data disclosure and work to resolve related legal issues and concerns.
Support the Bureau of Occupational Safety, Health, and Injury Prevention to provide advice and guidance to OMH facility managers on health and safety initiatives and challenges.
o Participate in the review of injury/assault data and perform on-site visits, advising facilities’ management on what legally can be changed to enhance safety.
o Provide oversight of safety initiatives.
Minimum Qualifications Transfer Opportunity:
Candidates must be employed by New York State to be eligible to apply for this position. Candidates must have permanent status as an Associate Director Human Resources 3 (Labor Relations), M-3, and be eligible for lateral transfer; OR be eligible to transfer via Section 70.1 or Section 52.6 of the Civil Service Law by having at least one year of permanent service in a qualifying title within two salary grades or one M-grade of this position.

Permanent appointment may be made by non-competitive promotion of an applicant who meets the position’s minimum qualifications if all requirements of a non-competitive promotion appointment are met. In order to be eligible for a non-competitive promotion examination, candidates must have one year of permanent competitive or 55-b/55-c service as an Associate Director Human Resources 2 (Labor Relations), M-2.
