Duties Description The Human Resources Specialist 3 Labor Relations, M-1, will report directly to the Associate Director Human Resources 2 Labor Relations, M-2. The incumbent will oversee discipline process statewide and ensure compliance with negotiated bargaining agreements. They will be responsible for the following, including but not limited to:
• Consults with the Associate Director of Human Resources 2, Counsel, and Executive staff as needed on union inquiries.
• Provides assistance to HRS1’s in drafting appropriate response.
• Oversees, directs, and provides guidance to the labor relations program for the Department of Labor.
• Directs the implementation of collective bargaining agreements.
• May represent the agency in both statewide and agency level negotiations; and directs or participates in labor management committees.
• Reviews and evaluates policies and procedures; and recommends and implements new and revised ones.
• Reviews and evaluates changes in negotiated agreements; and advises management of their impact on the labor relations program.
• Supervise lower level professional and clerical staff involved in labor relations activities.
• Provides advise and consultation to supervisors and managers to ensure proper interpretation and administration of contract provisions and avoid misunderstandings that may lead to employee dissatisfaction and grievances.
• Provides expert advice and assistance to program managers and supervisors in counseling and disciplinary matters as required.
• When needed, conducts the most difficult and sensitive hearings and investigations. Prepares witnesses for both direct and cross examination at disciplinary arbitration hearings, prepares and presents opening statement outlining witness testimony, case evidence, and theory of the case.
• Delivers closing argument summarizing major points of State’s case or drafts written brief summarizing main arguments and presenting persuasive discussion of management’s case.
• Assess labor relations training needs; and develops training materials and curricula regarding employee relations, collective bargaining, contract administration, and employee discipline.
• Assists the NYS Office of Employee Relations staff in presenting the State’s case at improper practice hearings before the Public Employment Relations Board.
• Acts as liaison with legal office on issues involving employee relations activity, including litigation involving disciplinary action or grievance determinations, and Equal Employment Opportunity Commission and Division of Human Rights complaints.
• Develops proposals for funding labor management projects from the various quality of work life committees and assists in their implementation.
• Build and maintain positive relationships with relevant stakeholders to support effective use of Labor Management processes.
• Create detailed reports on monthly basis, or as needed.
• Other duties as assigned in support of the labor relations program.

Ability to initiate and maintain relationships across a diverse set of stakeholders.
Demonstrated experience in mediating/arbitrating disputes involving government contracts or public sector employment highly desirable.

52.7 Non-Competitive Promotion (NCP) Qualifications: (DOL Employees Only)
To be eligible for NCP, candidates must be in the Department of Labor promotion field and have one (1) year or more of permanent, contingent-permanent or 55 b/c service as a Human Resources 2 Labor Relations. If 3 or fewer qualified Department of Labor Human Resources 2 Labor Relations respond to this posting, Civil Service may approve the permanent appointment of one of the qualified Human Resources 2 Labor Relations without further examination.

Note: Non-competitive refers to not competing in an examination; the appointment will be competitive.

52.6 Transfer Qualifications:
One (1) year of permanent or contingent-permanent as a Grade 23 or higher determined to be administrative by Civil Service.

Provisional Qualifications: (DOL Employees Only)
Department of Labor employees with one (1) year of permanent, contingent-permanent service or 55 b/c service as a Human Resources Specialist 2 Labor Relations, may apply. The appointed candidate would have to take, pass and be reachable on the next holding of the examination to be appointed permanently.

Additionally, in accordance with Civil Service Law, provisional service immediately prior to a permanent appointment to this title is now credited towards the completion of probation upon permanent appointment.
