Duties Description • Assist the Bureau Director in litigation matters.
• Handle administrative matters for the Bureau.
• Advise BOL attorneys on matters related to litigation.
• Provide litigation-specific training to BOL personnel and guidance to attorneys in the completion of their work.
• Develop standardized procedures for BOL staff to follow in carrying out routine legal tasks for which the Bureau is responsible.
• Provide legal coverage on behalf of BOL when the Bureau Director is unavailable.
• Review legal papers served or received and program staff’s requests for legal action to determine appropriate responsive action.
• Assign cases and subpoenas to attorneys for handling.
• Handle cases and subpoenas assigned by the Bureau Director.
• Prepare referral letters to the Attorney General and provide aid to the Attorney General in developing the agency’s case.
• Advise program staff of legal proceedings and developments in existing legal proceedings. Determine the agency’s position on issues raised. Work with DOH program staff to develop litigation strategies.
• Advise DOH program staff and Legal Affairs staff concerning litigation risk.
• Convey the agency’s position to the Attorney General’s office, advocate the agency’s position, and ensure that the agency’s position is expressed persuasively by the Attorney General’s office.
• Prepare indicated affidavits and other papers for use in legal proceedings.
• Prepare memoranda advising program staff and Legal Affairs staff of developments in legal proceedings and the ramifications of court orders and decisions.
• Maintain filing system, tracker system, and deadline system.

Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.

Preferred Qualifications: The preferred candidate must have strong legal writing, oral communication, and analytical skills. The candidate must be able to work as a member of a team, possess good decision-making skills, and must have the ability to handle high-volume activities in a deadline-driven environment. The ability to organize and prioritize a high volume of tasks is critical. The preferred candidate should be a highly motivated individual who is interested in working in an active legal team environment on matters involving a wide variety of public health issues.

Additional Comments *Salary Range from $115,283 - $145,682, commensurate with experience

This position may require travel throughout New York State including overnights to areas not served by public transportation.
