Duties Description The Trade Practices Bureau (“TPB”) focuses on the relationships between licensees in different tiers of the regulated cannabis market, as well as between licensees and third parties, to ensure fair competition and the prevention of deceptive or unfair business conduct.
The Deputy General Counsel will serve as the Director of the TPB and report directly to the General Counsel. The Director will be responsible for the supervision of the TPB including its educational efforts and compliance investigations.
Duties include but are not limited to:
• Direct, plan, and organize the work of the TPB.
• Supervise all attorneys, investigators, inspectors, data analysts, legal assistants, project managers, and support staff.
• Develop and implement policies and procedures for TPB operations.
• Draft findings of investigations and refer matters to the General Counsel for possible disciplinary action.
• Train all TPB staff on all aspects of TPB operations.
• Negotiate settlements of TPB investigations in consultation with the General Counsel.
• Engage with and educate industry stakeholders regarding trade practices.
• Conduct legal research and draft legal memoranda.
• Collaborate with all OCM divisions, managers, and personnel on ongoing trade practice regulation and investigations.
• Work with agency staff to manage, respond to, and investigate complaints of violations of laws and regulations related to trade practices.
• Represent the TPB at meetings with entities outside the agency, conferences, and other events, as requested by the Executive Director or General Counsel.
• Additional duties will be discussed in detail during the interview.
Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had eight years of experience in the practice of law subsequent to admission to the Bar.
Preferred Qualification:
• Experience in civil and criminal litigation and knowledge of the cannabis industry.
• Significant experience leading investigations, directing and supervising the work of attorneys and investigators or inspectors, as well as demonstrable knowledge of the cannabis industry and market dynamics.
NOTE: IN ORDER TO AWARD THE PROPER CREDIT FOR WORK EXPERIENCE, RESUMES MUST INCLUDE MONTH AND YEAR FOR START AND END DATES. IF ANY OF THIS EXPERIENCE IS LESS THAN FULL TIME YOU MUST INDICATE THE AVERAGE NUMBER OF HOURS WORKED PER WEEK.
Additional Comments NOTE:
• Travel may be required (approximately 25%), including during evening and weekends, depending on mission and assignment.
• Possession and maintenance of a valid Driver’s License issued by the NYS Department of Motor Vehicle is required, or otherwise demonstrate the capacity to meet the transportation needs of the job.
