Duties Description The NYSOH Appeals Unit is a unit of Hearing Officers who have jurisdiction to hear appeals from NY State of Health (Marketplace) applicants and enrollees involving eligibility and enrollment in Marketplace programs. As an appeals adjudicator for the NY State of Health (Marketplace), the incumbent (s) of this position will be responsible for conducting hearings arising from appeals of eligibility determinations for health insurance and financial assistance. The incumbent will also be responsible for conducting legal research and drafting decisions and dismissals resulting from those hearings. Incumbent (s) will also be responsible for other projects as assigned.
Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). HELPS Program titles may be filled via a noncompetitive appointment. This means that you do not need to take an exam to qualify, but you do need to meet the minimum qualifications of the title. If you are hired via HELPS, at a future date (within one year of permanent appointment), employees hired under NY HELPS are expected to have their permanent non-competitive employment status converted to permanent competitive status. You will not have to take an exam to gain permanent competitive status.
Non-Competitive Minimum Qualifications (HELPS):
Hearing Officer 1 (Administrative Law Judge), Grade 25 ($96,336): Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency.
Candidates who do not meet the minimum qualifications for Hearing Officer 1 (Administrative Law Judge) can be appointed to a lower-level title and be advanced to the Hearing Officer title after meeting the requirements for advancement. The trainee level appointments available are:
Assistant Attorney 2, Grade NS ($74,193): Admission to NYS Bar
Assistant Hearing Officer, Grade, NS ($82,326): Admission to the NYS Bar and one year of subsequent professional legal experience
NOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment. Position may be filled at the Hearing Officer 1 level or one of the Assistant Hearing Officer traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected. This position may be designated 55-b/c and is subject to verification of applicant eligibility.
Reassignment: Current NYS Department of Health (DOH) employee with permanent or contingent permanent status as an Assistant Hearing Officer, NS, or Hearing Officer 1, G-25.
Transfer: Current NYS employee with one year or more of permanent or contingent-permanent, competitive service in a position eligible for transfer under Section 52.6 or 70.4 of the Civil Service Law.
Preferred Qualifications: The preferred candidate will have experience working as counsel for public health insurance programs and/or with a legal services organization specializing in health law, in addition to experience in administrative law hearings.
Additional Comments Please be advised that all hires into these positions must submit to mandatory fingerprinting and an associated background investigation, including state and national criminal history record checks, to ensure suitability for employment and/or continued employment. Candidates will not be required to pay the fees associated with mandatory fingerprinting. Depending on, the criminal convictions discovered, or any falsified or omitted information revealed, the investigative findings may bar appointment or result in removal after appointment. Please note that the selected candidate, should they continue to have access to Federal Tax Information (FTI), must submit to a mandatory reinvestigation every five (5) years.
This position is part of the NYS HELPS program. No examination is required.
