Duties Description Under the general direction of the Deputy Counsel for Finance, the Associate Attorney will support the Office of Counsel, Bureau of Finance in providing legal advice on Medicaid and Medicare financing, reimbursement methodologies, and related policy development. Specific duties to be performed may include, but are not limited to, the following:

- Advise on Medicaid audit disallowances.
- Collaborate with the Department of Health and other stakeholders on State Plan Amendments and federal waiver activity.
- Provide legal guidance on financing structures and compliance with federal and State requirements.
- Advise senior leadership on fiscal and policy matters impacting the delivery of mental health services.
- Review and develop agency policy from a legal perspective.
- Address confidentiality, data sharing, and compliance issues under the Mental Hygiene Law and other applicable authorities.
- Serve as the agency’s HIPAA Privacy Officer by providing legal guidance on confidentiality, privacy, and data-sharing issues under HIPAA, section 33.13 of the Mental Hygiene Law, and other applicable privacy statutes and regulations.

Minimum Qualifications Candidates must be currently reachable on the appropriate eligible list for this title or eligible to transfer to this title under Section 52.6 of the Civil Service Law.

Transfer:
Candidates must have permanent status as an Associate Attorney and be eligible for lateral transfer; OR be eligible to transfer via Section 52.6 of the Civil Service Law by having at least one year of permanent service in a qualifying title within two salary grades or one M-grade of this position.
