Duties Description The Assistant Counsel, NS-25, will work in the Litigation Section of the Office of General Counsel (OGC) on litigation matters arising under or relating to the Public Service Law, DPS regulations, and Public Service Commission (Commission) orders. Under the direction of managing attorneys, duties will include, but are not limited to:
• Representing DPS and the Commission in court proceedings to review administrative determinations, including challenges to siting certificates for utility-scale renewable generation and transmission projects issued under Public Service Law article VIII.
• Drafting briefs, affirmations, and other legal documents.
• Helping colleagues prepare for oral argument by participating in moot courts.
• Researching and interpreting complex statutes and regulations, Commission orders, and policy documents.
• Working with engineers, economists, and other expert agency staff to master technical, policy, and regulatory issues related to pending litigation.
• Appearing for the Commission in administrative proceedings relating to interstate electric, natural gas, and telephone service.
• Analyzing legal issues related to potential Commission actions.
• Drafting Commission orders in consumer-protection matters.
Minimum Qualifications Admission to the New York State Bar and two years of experience in the practice of law subsequent to Bar admission.
Preferred candidates would have at least two years of litigation experience and should possess excellent legal research and writing skills. Public-sector experience, experience in administrative or regulatory law (including in the environmental, energy, telecommunications, or utilities sectors), and/or appellate experience is also preferred. Prior judicial clerkship experience, especially at the appellate level, may substitute for some or all of the preferred two-year litigation experience.

Unlike at most State agencies, DPS attorneys directly represent the agency and its governing body, the Public Service Commission (Commission), in state and federal court proceedings at both the trial and appellate levels.
Remarks:
Salary will be commensurate with experience. The primary location for this position is Albany, NY, with at least 10% travel which requires a valid driver’s license. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority. Appointment to this position is contingent upon Division of Budget approval.
