Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have one year of permanent competitive service as an Agency Labor Relations Representative 1 OR have one year of permanent competitive service in a title SG-21 or above deemed eligible to transfer under Section 52.6 of the Civil Service Law OR be reachable on the Agency Labor Relations Representative 1 eligible list.

Duties Description The New York State Education Department (NYSED) is seeking to fill two (2) Agency Labor Relations Representative (ALRR) 1 positions in the Office of Human Resources Management (OHRM). OHRM provides personnel, staff development, labor relations and employee benefits services to staff in various program areas within the Education Department, including the: Office of P-12 Education; Office of Adult Career and Continuing Education Services; Office of the Professions; Office of Cultural Education; Office of Higher Education; Office of Performance Improvement and Management Services; Office of the Chief Financial Officer; and two schools operated by NYSED in Rome and Batavia. Under the direction of the ALRR 3, the ALRR 1 will assist in the administration and maintenance of the labor relations program by administering the employee discipline and grievance procedures, participating in labor management meetings, and providing technical assistance to employees and managers regarding the negotiated contracts. The duties of this position will include, but not be limited to, the following:

• Serve as the management representative on agency labor/management subcommittees;
• Advise supervisory staff regarding the review and response to Step 1 grievances;
• Conduct Step 2 grievance hearings and draft related decisions;
• Conduct investigations of employee misconduct;
• Investigate workplace violence complaints not involving physical assault or sexual harassment;
• Consult with and provide advice to managers and supervisors regarding the proper interpretation and administration of the State’s collectively bargained agreements with PEF, CSEA, NYSCOPBA and Council 82;
• Conduct disciplinary interrogations, prepare and issue notices of discipline, and represent the agency’s interests at disciplinary arbitrations;
• Advise supervisors regarding performance management and the performance evaluation process;
• Represent the agency’s position at performance evaluation appeal hearings;
• Conduct pre-termination hearings pursuant to Section 73 of the NYS Civil Service Law;
• Assist with the representation of NYSED’s position at appeal hearings conducted pursuant to Sections 71 and 72 of the NYS Civil Service Law; and
• Assist in the development and delivery of training to NYSED staff on specific components of the labor relations context such as those related to employee organizational leave, counseling, and progressive discipline.

Additional Comments CONDITIONS OF EMPLOYMENT: Both positions will be permanent appointments. Filling of these positions are contingent upon Division of Budget approval.
