Duties Description The New York State Education Department’s (NYSED) Office of Education Policy is seeking candidates for an Associate Attorney position in the Office of Special Education (OSE) State Complaint and Document Retention Unit. OSE works to promote educational equity and excellence for students with disabilities, oversees the implementation of federal and State laws and policies for students with disabilities, provides general supervision and monitoring of all public and private schools in New York State serving preschool and school-age students with disabilities, and provides technical assistance to parents and school districts. The State Complaint and Document Retention Unit is responsible for investigation of state complaints, oversight of OSE Freedom of Information Law (FOIL) requests and development, implementation, and maintenance of an office-wide electronic filing system. Under the direction of the Chief, Special Education Services, the incumbent of this position will be responsible for activities, to ensure NYSED compliance with the federal Individuals with Disabilities Education Act (IDEA). Duties of this position include, but are not limited to, the following:
· Oversee and coordinate all the activities of the State Complaint and Document Retention Unit, including investigations of state complaints, FOIL requests, and appropriate retention of documents received and generated by the OSE.
· Serve as liaison to Office of Counsel for guidance and support on state complaints, FOIL requests, and retention of documents.
· Ensure policies and procedures for state complaints, FOIL processes and retention of office-wide documents are up to date and implemented consistent with state and federal requirements.
· Ensure consistency, accuracy, and adherence to federal and state requirements in response to state complaints and FOIL requests.
· Ensure unit staff have appropriately redacted personally identifiable information in response to FOIL requests.
· Oversee and coordinate the retention of documents, including development, implementation, and maintenance of an office-wide electronic file for pertinent documents.
· Ensure unit staff receive cross training and ongoing support, as needed to perform the unit duties.
Minimum Qualifications PROMOTION: Current NYSED State employees must have one year of permanent service as a Senior Attorney.
Reassignment: Candidates must have one year of permanent competitive as an Associate Attorney.
Eligible List Appointment: Candidates must be reachable on the Civil Service eligible list for this title. If you are on the Civil Service eligible list for this title, you may receive a canvass letter. You must complete and return it as instructed on the letter.
Section 52.6 Transfer: Candidates must have one year of permanent competitive in a title SG-26 or above deemed eligible for a transfer under Section 52.6 of the Civil Service law and possess a Juris Doctorate degree and be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity. Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent appointment. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree, Bar admission and work experience will be required at the time of interview for all candidates. Candidates are required to possess and maintain admission to the New York State Bar. Continued employment as an associate attorney is dependent upon maintaining current registration to practice law in New York State. Failure to maintain this registration will result in removal from employment. This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period at the discretion of the unit supervisor. This position will require 10% in-state travel.
Federal law may impose additional requirements or restrictions regarding positions that receive federal funding.
This position leads to a maximum salary of $138,203 based on annual performance advances.
