Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have a Master’s Degree or higher and at least five years of relevant senior level leadership and management experience including a record of proven results and responsibility for a major complex office or institution of higher education, education or government including experience and educational experience related to special education and/or services to children with disabilities.

Duties Description The New York State Education Department’s Office of Education Policy is seeking candidates to fill the position of Assistant Commissioner of Special Education in its Office of Special Education. The Office of Special Education, with approximately 140 staff persons, works to promote educational equity and excellence for students with disabilities, provides general supervision and monitoring of all public and private schools serving New York State preschool and school-age students with disabilities, and provides technical assistance to parents and school districts. Duties of the position will include but not be limited to the following:

• Direct the work of a Statewide operation; consisting of approximately 140 employees in the central and regional offices;
• Oversees all aspects of the Individuals with Disabilities Education Act (IDEA) including the development of the State Performance Plan and Annual Performance Reports and the State Systemic Improvement Plan;
• Manages the development of proposals for State law and regulation, and development of policy and guidance to ensure New York State’s compliance with IDEA and the achievement of students with disabilities;
• Ensures that technical assistance is provided to school districts, parents and other special education programs to improve educational outcomes for students with disabilities;
• Oversees the operation of seven regional offices throughout NYS responsible for the monitoring and oversight of approximately 700 school districts and hundreds of private preschool and school age programs, delivering services to students with disabilities;
• Directs the alignment of general education and special education policies and procedures including the implementation of the Every Student Succeeds Act (ESSA) and IDEA accountability;
• Oversees provision and oversight of grants and contracts for approximately 90 million dollars of IDEA Discretionary funds for special education initiatives;
• Oversees the approval of Preschool and private school programs serving students with disabilities;
• Manages the implementation of networks of technical assistance and professional development statewide to support schools, parents and educators;
• Oversee the operation of the New York State School for the Deaf and the New York State School for the Blind:
• Ensure the appropriate membership and operation of the Commissioner’s Advisory Panel for Special Education;
• Work in collaboration with the Office of Counsel relative to special education litigation in NYS;
• Manages the implementation of NY’s due process system for special education;
• Represents NYS on the National Association of State Directors of Special Education;
• Work in collaboration with external stakeholders and advocacy groups in support of students with disabilities; and
• Ensure the Department meets all obligations of the NYS Justice Center for the Protection of People with Special Needs in relations to investigations of abuse, neglect and significant incidents in residential schools.

Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education.
