Minimum Qualifications MINIMUM QUALIFICATIONS:
Candidates must be reachable on the current Civil Service Legal Specialties List or be eligible to transfer under Section 70.1 or 52.6 of the Civil Service Law.
Duties Description POSITION DESCRIPTION:
The Office of Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. Attorneys are called upon to draft and review legislation, regulations, contracts, real property transactions, advise on compliance with Medicaid programs for people with developmental disabilities, advise on employment matters, participate in administrative hearings and oversee litigation.
PRIMARY DUTIES AND RESPONSIBILITIES:
• Research and advise on program requirements for Medicaid and Medicare funded services for individuals with developmental disabilities
• Research and advise on issues related to various administrative processes such as eligibility and approval for services, Medicaid fair hearings
• Research and advise on issues related to State and Federal audits
• Represent the agency in connection with trusts, estates and guardianship of property transactions
• Provide legal counsel to the agency related to contracts and memoranda of understanding (MOU)
• Provide legal counsel to the agency on matters related to confidentiality and records access including HIPAA, Mental Hygiene Law and FOIL
• Provide support to the Attorney General as needed
• Assist in drafting and reviewing proposed legislation and regulations
• Perform other tasks as assigned by supervisor and General Counsel
