Minimum Qualifications MINIMUM QUALIFICATIONS:
Reassignment: One year of permanent competitive or 55b/c service as an Associate Attorney.

Eligible List Appointment: Candidates who are reachable on the Associate Attorney eligible list may be considered for appointment.

§52.6 Transfer: One year of permanent competitive or 55b/c service in a title SG-26 or above deemed eligible for transfer under §52.6 of the Civil Service Law AND a Juris Doctorate degree AND be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity.

Duties Description The New York State Education Department’s (NYSED) Office of State Review (OSR) is seeking applicants for the position of Associate Attorney. The OSR assists the New York State Review Officer (SRO) in reviewing appealed decisions of impartial hearing officers concerning the identification, evaluation, program, or placement of children who have, or are suspected of having, an educational disability. The incumbent will work closely with OSR's Management Team and motivate staff by leading by example, hard work and commitment. Duties of this position will include, but are not limited to, the following:

• Assist with the rapid screening and assignment of appeals to subordinate attorneys, track and report cycle time, and ensure quality decisions consistent with federal and State laws, and litigation matters;
• Review and edit draft decisions for accuracy, thoroughness, consistency, and quality within designated time lines;
• Provide support for the SRO in fulfilling the mission of the office by ensuring implementation of office policies and procedures as developed by the SRO;
• Supervise subordinate attorneys and conduct employee performance evaluations;
• Provide constructive comments and guidance to all staff and convey and facilitate an understanding of the office mission;
• Assist in the defense of the decisions of OSR by the Attorney General or other attorneys in federal and State court in precedent setting and frequently technically complex litigation;
• Maintain a high degree of expertise in special education law, legal research and legal writing;
• Prepare and/or guide subordinate attorneys in preparing written draft decisions in highly complex cases in which there is little precedent while accurately identifying the relevant factual and legal issues to be determined;
• Make recommendations to the SRO in a clear, concise and logical manner;
• Manage assignments to ensure timely completion of quality decisions; and
• Work collaboratively and effectively with other managers and/or supervisors.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a permanent appointment. Promotions and transfers may change appointee’s negotiating unit. Continued employment as an Associate Attorney is dependent upon maintaining current registration to practice law in New York State.
