Minimum Qualifications A minimum of two (2) years of federal and/or state court civil litigation experience is required. Prior employment law and complex litigation experience is preferred. Superior research, writing, oral advocacy, analytic, and organizational skills are also required.

Applicants must reside in (or intend to soon become a resident of) New York State, and be admitted to practice law in New York State. Admission to the United States District Courts for the Southern and Eastern Districts of New York is preferred. In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The Public Health Administration (PHA) Section of the Litigation Bureau in the New York State Office of the Attorney General (OAG) is seeking an experienced litigator to serve in the New York City office.

The Litigation Bureau represents the State of New York and its agencies and officers in federal and state courts in civil actions and proceedings involving civil rights, education, social services, public employment, public health, law enforcement, corrections, state finance, insurance, taxation, and other litigation matters arising out of state legislation, regulations, and operations.

Attorneys assigned to the Public Health Administration Section primarily represent and defend the Department of Health, Office of the Medicaid Inspector General, Board for Professional Medical Conduct, and the State Education Department’s Office of Professional Discipline. The Section’s attorneys handle a wide variety of state and federal court actions involving, among other things, state public health law requirements, the regulation of health care providers, disciplinary proceedings against physicians and other medical professionals for misconduct, and licensing of home care providers; as well as labor and employment, civil rights, and administrative law issues. The Section’s cases are often high profile, frequently present complex questions of constitutional law and statutory and regulatory interpretation, and have significant policy and financial implications for the State. The Section offers a diverse and stimulating litigation practice, with attorneys handling all phases of litigation from inception through trial, including appellate division review in professional disciplinary matters, and have frequent opportunities to present written and oral arguments in court.
