Minimum Qualifications Appointment method:
Candidates must meet the minimum qualifications listed below in order to be eligible for appointment.
Non-Competitive:
Admission to the New York State Bar and four years of legal experience subsequent to admission to the NYS Bar. Legal experience must be in one or more of the following fields: litigation or financial industry investigations; corporate law involving such actions as corporate mergers, dissolutions, stockholder meetings and other related corporate actions; commercial financial documentation and negotiation; bank regulatory experience; insurance regulatory and legislative experience; and prosecutorial experience gained in a city, state, or federal law enforcement or administrative agency that regularly conducts civil enforcement action in financial and commercial matters.
A master’s degree in law with a concentration in Banking Law, Insurance Law, Financial Services Law, Corporate Law, or international legal studies may substitute for two years of the experience.

Duties Description The New York State Department of Financial Services seeks to build an equitable, transparent, and resilient financial system that benefits individuals and supports business. Through engagement, data-driven regulation and policy, and operational excellence, the Department and its employees are responsible for empowering consumers and protecting them from financial harm; ensuring the health of the entities we regulate; driving economic growth in New York through responsible innovation; and preserving the stability of the global financial system.
The Department of Financial Services is seeking candidates for the position of Associate Attorney Financial Services in Health Bureau within the Insurance Division. Duties include, but are not limited to, the following:
• Oversees implementation and compliance with federal and state laws, including state mental health and substance use disorder treatment parity laws and MHPAEA;
• Analyzes health insurance contract forms submitted for approval to the Department of Financial Services (DFS) and evaluates for compliance with all applicable federal and state statutes, rules, and regulations;
• Drafts, reviews, analyzes, and comments on legislative proposals, regulations, and circular letters, and demonstrates knowledge of the State Administrative Procedure Act (SAPA) requirements for rulemaking;
• Reviews submissions from health insurers to determine compliance with federal and state mental health and substance use disorder parity laws including rates of utilization review approvals and denials, rates of appeals, claims paid, cost-sharing requirements, and participation rates of providers;
• Conducts mental health and substance use disorder parity compliance investigations, analyzes the results of such investigations, prepares concise and effective written memoranda on the findings, and drafts consent orders;
• Implements network adequacy standards and oversees network adequacy reviews, including in relation to behavioral health services;
• Assists in the handling of special projects or the operations of health insurance programs;
• Researches and prepares special reports and drafts legal memoranda with an ability to produce a high-quality written work product;
• Meets with representatives of the health insurance industry, trade groups, and other governmental agencies to discuss public policy, market and product issues, mental health and substance use disorder parity requirements, and other initiatives, and effectively communicates Department position;
• Participates in task forces and workgroups with the health insurance industry or other governmental agencies;
• Trains and supervises staff within a legal section of the DFS Health Bureau; and
• Other duties as assigned.

Salary: The starting salary for this position is $108,665 with periodic increases up to $137,319

Positions located within the New York City metropolitan area, as well as Suffolk, Nassau, Rockland, and Westchester Counties, are also eligible to receive an additional $3,400 annual downstate adjustment.
