Minimum Qualifications Preferred Qualifications: Admission to the New York State Bar and a member in good standing with at least 3 years post NYS Bar admittance legal experience as a practicing attorney. Knowledge and experience with NYS and federal legislative and regulatory processes, as well as experience in legislative drafting and negotiation a plus. Notaries are preferred.

Duties Description The Office of Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. The Associate Counsel in this position will report to the General or Deputy General Counsel and provide high level support and legal assistance to the Commissioner, Executive Deputy Commission, General Counsel, legal staff and other members of the agency's executive team and will liaise with the Director of Intergovernmental Affairs and Chief Strategy Officer on the Agency's legislative agenda, bills of interest, and the executive budget making process. The Associate Counsel will manage the Bureau of Policy and Regulatory Affairs. Duties include but are not limited to the following:
·Provides legal support for the development and implementation of proposals to amend the State's legislation, regulations or agency policies.
-Tracks and reviews proposed and pending federal and state legislation for legal sufficiency and effect on the agency, identifying
trends and strategies to enhance the service system legislatively.
-Conducts research, reviews and provides legal analysis of legislative proposals including justification, impact to programs, and
fiscal impact.
-Provides legal recommendations and draft changes where appropriate.
-Drafts legislation and guides proposal through the legislative process
-Oversee the agency's role in executive budget negotiations and departmental submissions.
-Provides legal support in implementing adopted legislation.
-Oversee the drafting and implementation of agency regulations.
·Provide legal advice, assistance, and guidance to Counsel's Office staff, Executive level leadership, and OPWDD employees on subjects related to regulatory affairs, legislative matters, records access, privacy, ethics,
and administrative hearings.
-Researches and analyzes legislative issues or external proposals that impact agency operations:
-Provides analysis and interpretation of existing laws and regulations, particularly in new/emergent areas.
-Analyzes proposed or new legislation, directives, and/or policies for impact on agency policies, practices, and operations.
-Conducts legal research of statutes, decisions, opinions, and other sources to respond to requests and inquiries.
-Distills and communicates legislative information to agency staff.
-Provides coordinated agency feedback to internal and external stakeholders.
·Serves as/or oversee the agency Ethics Officer:
-Provides guidance and advice to agency staff on ethics questions/issues, compliance with ethics laws, rules, regulations, and agency policies.
-Acts as liaison with Commission on Ethics and Lobbying in Government (CELG) to communicate agency compliance, receive updates and disseminate to staff.
-Ensure training for agency staff is scheduled and conducted; participate in the delivery of training.
-Review and approve/disapprove employee requests for outside employment and activities.
·Supervise and direct responses to Agency's Freedom of Information Law requests, requests for records, record retention policies.
·Oversee agency's HIPAA compliance and compliance with other privacy laws.
·Participate as a member of the Office of Counsel Management Team
-Supervise attorneys and other staff within the Office of Counsel. Perform supervisory functions, such as assigning work, managing workload, preparing evaluations, approving time off.
-Reviews work from staff members for quality; ensure agency's perspective, policies and goals are considered and supported.
-Offer legal opinions and make recommendations to agency staff from various program areas; ensure agency actions are legally supported.
-The Associate Counsel may also be assigned to other program areas or special projects as needed and at the discretion of the General or Deputy Counsel.
-Represent the agency at internal and external meetings.
-Make presentations at executive team meetings or in other forums on legal issues related to Medicaid program integrity and/or agency operations.
