Non-Competitive Qualifications for appointment under the NYHELPS Program:
• For appointment to the Assistant Attorney 1 you must have: Law school graduation and/or eligibility for the NYS Bar Admission.
• For appointment to the Assistant Attorney 2 you must have: Admission to the NYS Bar.
• For appointment to the Assistant Attorney 3 you must have: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.
• For appointment to the Senior Attorney, you must have: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience

OR

Competitive Minimum Qualifications:
70.1 Transfer:
For a 70.1 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 70.1 title allocated to a salary grade 23 or above.

52.6 Transfer:
For a 52.6 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 52.6 title allocated to a salary grade 23 or above and must have 12 months as an Assistant Attorney 3 OR admission to the New York State Bar AND 24 months of subsequent satisfactory legal experience.

Duties Description Senior Attorneys provide legal assistance and support to agency program administrators by analyzing legal opinions, briefs and other material, preparing memoranda of law and conferring with administrators or parties to legal action in order to mediate, negotiate or settle legal issues directly related to the agency's program. Senior Attorneys function either as specialists in a single program governed by law or in a more general atmosphere as evidenced by their concern with laws governing numerous programs.

Incumbents of this class may perform a wide range of assignments and the tasks performed vary considerably within the framework described in this standard.

Additional Comments Desired Competencies:
• Admission to the NYS Bar.
• At least one year of experience practicing law in NYS.
• Fundamental understanding of NYS laws pertaining to municipal government and finance, including the imposition of taxes and assessments, and borrowing.
• Fundamental understanding of the structure and function of NYS local governments.
• Excellent written and oral communication skills.
• Ability to organize large volumes of factual and legal data into clear and logical sequences.
• Ability to analyze legal issues and identify significant cases, opinions and facts.

Telecommuting:
The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s duties and work performance are aligned with telecommuting they may be allowed to do so. Upon approval to telecommute, OSC employees may telecommute up to 5 days per pay period.
