Salary RangeFrom $90931 to $114940 Annually
Minimum Qualifications A Juris Doctor or Doctor of Law degree and admission to the New York State Bar Association, or admission to the Bar of a State/Commonwealth other than New York; and three (3) years post-admission experience in adversarial proceedings including, but not limited to, criminal law arbitration, formalized fact-finding proceedings, dispute resolution proceedings, or other litigation practices.
Duties Description 1. Preside over administrative proceedings involving incarcerated individuals at assigned correctional facilities.
2. Arrange for witness testimony and documentary and video evidence.
3. Ensure that appropriate standards of due process are met, determine the relevancy and admissibility of evidence, and demonstrate appropriate demeanor and impartiality throughout the hearing process.
4. Evaluate evidence presented, resolve issues of law and fact, and consider mitigating and aggravating circumstances.
5. Prepare decisions that includes statements of the evidence relied upon and thorough explanations for the dispositions rendered, including the justification for any sanctions or programmatic referrals imposed.
6. Electronically record all hearings conducted and develop a complete paper record in a manner that may be utilized in the event of future litigation.
7. Maintain an appropriate degree of independence and regular contact with Counsel's Office supervisory staff.
8. Additional duties may include but are not limited to attendance at Departmental trainings, meetings, occasional travel to assist other hearing officers and drafting of Freedom of Information Law (“FOIL”) appeal responses on behalf of the Department and any special assignment or detail from the Deputy Commissioner and Counsel.
