Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have been admitted to the New York State Bar AND have three years of relevant, post-graduate experience, including significant trial work or administrative hearing experience, demonstrating progressively responsible experience in such areas.
Duties Description The New York State Education Department’s (NYSED) Office of Professions (OP) is seeking candidates for an Assistant Counsel position in the Office of Professional Discipline’s (OPD’s) Upstate Regional Office(s). OP regulates over 50 professions licensed by the New York State Board of Regents. Under the direction of OPD management and a supervising attorney, the incumbent of this position will participate in the development and review of investigations into allegations of professional misconduct. Duties of this position include, but are not limited to, the following:
• Provide legal advice to members of the various State boards for the professions;
• Represent OP before the Regents Review Committee, which reviews decisions of hearing panels in professional misconduct cases;
• Research and prepare well-written briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence;
• Ensure the effective and timely management of all caseloads;
• Interact courteously and effectively with members of the Board of Regents and the various State professional boards, other SED staff, opposing counsel, witnesses, and members of the public; and
• Undertake various legal, administrative, special projects, and management responsibilities throughout the Office of the Professions.
Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education. Salary will be commensurate with education and experience. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of admission to the New York State Bar will be required at the time of interview for all candidates. This position will require frequent same-day travel and occasional overnight State-wide travel. This position allows for the opportunity to telecommute up to 30% each bi-weekly pay period and is granted at the discretion of the supervisor and the appointing office. Filling of this position is contingent upon Division of the Budget approval.
