Duties Description Under the general direction of the Minority and Women-owned Business Enterprise (MWBE) VP of Utilization, the incumbent will lead the compliance team to monitor New York State agencies’ and authorities’ statutory compliance with the provisions of New York State Executive Law, Article 15-A and related rules and regulations, such as Title 5 of the New York Codes, Rules and Regulations, concerning the utilization of MWBEs on state contracts. The incumbent will assist in the formulation and implementation of policies related to the MWBE program. Travel may be required.

Duties include but are not limited to:
· Provide guidance, support, and training to the compliance team, answer questions about Article 15-A and Title 5 compliance, and track staff performance.
· Assist with the formulation and implementation of policies related to the MWBE program, specifically regarding NYS agencies’ and authorities’ compliance with the program rules and regulations, and provide recommendations and guidance when new legislation or rules affecting the MWBE program are adopted or proposed.
· Monitor the receipt of allegations of misconduct and ensure Compliance Analysts are responding to complaints in a timely manner by researching valid allegations of misconduct, and report/refer any compliance issues or potential misconduct to the VP of Utilization, the Executive Director and the MWBE Legal Team.
· Assist the Legal Department with responding to the Division FOIL requests and ensure that all required documents are compiled, and relevant reports are generated across the units.
· Review reports submitted by the State Agencies and Authorities, including but not limited to the agency goal plans, utilization plans, utilization reports, waivers, and ensure that agencies are in compliance with the 15-A and Title 5.
· Conduct periodic program surveys with agencies and authorities regarding MWBE waivers, contract violations, and the New York State Contract System (NYSCS), as well as regular reviews of agencies’ and authorities’ MWBE programs to ensure program compliance, maximization of MWBE contract opportunities, and proper reporting procedures.
· Serve as a subject matter expert on NYSCS Compliance Module and the MWBE Operations Primer and provide hands-on training on these topics to internal and external audiences as necessary.
· Make recommendations as they relate to improving and strengthening compliance with the program rules and regulations and assist the Legal Department and the Division with conducting disparity studies.
· Focus effort to streamline operations and develop new policies, procedures, and manuals for the compliance team; develop materials and trainings on compliance.
• Perform other special projects as reasonably required by the VP of Utilization or Executive Director.

Minimum Qualifications Nine years of experience in MWBE/Affirmative Action, community economic development program, and/or audit compliance experience. Two years of experience must have been at a supervisory level.

Substitutions: The following substitutions for the experience described above may be applied as follows:
An associate degree in business, marketing, economics, public administration, or public policy substitutes for two years of general experience; OR
A bachelor’s degree in one of these same fields may substitute for four years of general experience; OR
A J.D. or master’s degree in one of these same fields may substitute for one additional year of general experience.
Preferred: One year of procurement and contract management experience.

Additional Comments SALARY RANGE: $103,784 - $127,830 (plus $3,400 location pay)
Note: The starting salary for candidates with no prior State service will be set at the minimum hiring rate.
