Duties Description Basic Function: Under the supervision and mentorship of the director and assistant director, Trial Examiners perform the work of an Administrative Law Judge (ALJ). ALJs are the first-level judges in the administrative labor relations framework established in New York State by the Taylor Law and the State Employment Relations Act. They perform the crucial role at PERB of conferencing (e.g., mediating) and, if necessary, ruling after hearing on labor and management disputes and issues.
WORK PERFORMED: As an Assistant Trial Examiner 1-3, the incumbent will work under close guidance in a trainee capacity to perform the work of an ALJ. In less complex matters and under close supervision, they will prepare for and conduct prehearing conferences and assist the parties to reach an agreement. If resolution is not possible, they will conduct a hearing. They will prepare a decision in representation matters and in improper practice cases which, in both types of cases, contain a statement of the issue and relevant facts, together with a discussion and analysis of appropriate precedents. Senior Trail Examiners work more independently in a similar capacity.
Minimum Qualifications Assistant Trial Examiner 1 (SG18): Law School Graduation (or other eligibility to take the NYS Bar Examination)
Assistant Trial Examiner 2 (SG20): Admission to NYS Bar
Assistant Trial Examiner 3 (SG22): One year as Assistant Trial Examiner 2 or admission to the NYS Bar and one year of subsequent professional legal experience*
Senior Trial Examiner (SG M1): One year as an Assistant Trial Examiner 3 or admission to the NYS Bar and two years of subsequent professional legal experience*
Salary Information:
$65,164 - $80,60 (SG18)
$72,160 - $89,332 (SG20)
$80,138 - $98,882 (SG22)
$90,931 - $114,940 (SG M1)
The level at which a candidate is appointed will be dependent upon the minimum qualifications met. If hired as a trainee (Assistant Trial Examiner 1 – 3), the successful completion of each traineeship level will result in a promotion to the next level, up to a Senior Trial Examiner.
*Professional legal experience is defined as experience in the field of labor-management law and labor-management relations primarily under the Taylor Law or similar collective bargaining laws including but not limited to experience as a neutral deciding or resolving disputes over terms and conditions of employment or representation issues or as an employer or union advocate in the adjudication and resolution of such labor-management disputes.
