Minimum Qualifications MINIMUM QUALIFICATIONS: Candidates must have a J.D. degree, be admitted to the New York State Bar, have at least three years of legal experience, and have a background in Education Law or significant civil litigation or legal writing experience such as appellate brief writing or judicial clerkship experience. Preferred applicants will have experience related to special education matters, administrative proceedings and litigation; possess excellent writing and oral communication skills; and have managerial and/or supervisory experience or ability.

Duties Description The New York State Education Department’s Office of State Review is seeking applicants for a position of Assistant Counsel and State Review Officer, M-3. The Office of State Review (OSR) assists the State Review Officer (SRO) in reviewing the decisions of impartial hearing officers concerning the identification, evaluation, program or placement of children who have, or are suspected of having, an educational disability. This is a critical leadership position in OSR, and the incumbent must be able to motivate and inspire staff by leading by example, hard work and commitment. Duties of this position will include but not be limited to:
• Ensuring that SRO decisions in assigned appeals are reviewed and issued in a timely manner consistent with federal law and include a comprehensive analysis of the facts and law;
• Maintaining Department standards by ensuring that decisions of the SRO accurately and adequately identify the relevant issues in reviews, effectively resolve the issues and provide the parties with appropriate directions to assure compliance with the requirements of federal and State law;
• Assisting in the defense of the decisions of OSR by the Attorney General or other attorneys in federal and State court in precedent setting and frequently technically complex litigation;
• Assisting in the effective management of OSR, including rapid screening and assignment of appeals, tracking and reporting of cycle time, and ensuring quality decisions consistent with federal and State laws;
• Working collaboratively with other SROs in fulfilling the overall mission of the office by participating as an effective member of the management team and ensuring implementation of office policies and procedures; and
• Supervising assigned staff and conducting employee performance evaluations.

Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education. Filling of this position is contingent on Division of the Budget approval.

*Leads to a maximum salary of $104,080 based on annual performance advances.
