Duties Description Reporting to the Deputy Counsel, the Assistant Counsel will join the Office of General Counsel’s Cannabis Control Board (CCB) team. The Assistant Counsel will be responsible for analyzing matters submitted to the CCB for final determination, conducting necessary legal research and preparing written recommendations to the Board regarding such requests. The role is also responsible for assisting with the review and preparation of material for the CCB’s review at board meetings.
Duties include, but are not limited to:
• Assist with the receipt and organization of administrative appeals submitted to the CCB for review.
• Review appeals from administrative hearing determinations and prepare written recommendations to the CCB regarding the determination of such appeals.
• Review requests to the CCB for the granting of a license or location amendment as promoting a public convenience and advantage and prepare written summaries.
• Prepare written decisions for actions taken regarding requests for public convenience and advantage matters.
• Assist with the review and preparation of materials, proposed regulations, and resolutions for CCB meetings.
• Analyze and summarize cases and information pertinent to constitutional provisions, statutes, rules, and regulations.
• Review, analyze, and comment on changes in laws, rules, regulations, and other legal matters concerning the CCB’s compliance and the effect on agency programs.
• Assist with analyzing and drafting proposed legislation for impact on agency rules and regulations.
• Prepare other legal memoranda as requested by the Deputy Counsel or the General Counsel to assure technical accuracy, completeness, and soundness of approach.
• Interpret pertinent laws, rules, regulations, and procedures.
• Other duties as assigned by the Deputy Counsel or the General Counsel.
Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had two years of experience in the practice of law subsequent to admission to the Bar.
NOTE: IN ORDER TO AWARD THE PROPER CREDIT FOR WORK EXPERIENCE, RESUMES MUST INCLUDE MONTH AND YEAR FOR START AND END DATES. IF ANY OF THIS EXPERIENCE IS LESS THAN FULL TIME YOU MUST INDICATE THE AVERAGE NUMBER OF HOURS WORKED PER WEEK.
Additional Comments NOTES:
• Travel may be required (approximately 10%), including during evening and weekends, depending on mission and assignment.
• Possession and maintenance of a valid Driver’s License issued by the NYS Department of Motor Vehicle is required, or otherwise demonstrate the capacity to meet the transportation needs of the job.

Downstate: Location Pay of $4,000.
