Duties Description The Office of Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. Attorneys are called upon to draft and review legislation, regulations, policy, contracts, and real property transactions, advise on compliance with Medicaid programs for people with developmental disabilities, certification, and approval of providers of services, employment matters, participate in administrative hearings and oversee litigation. The Associate Counsel in this position will supervise the Medicaid Fair Hearings Unit within Counsel's Office and will:

-Serve as a member of the Counsel's Office leadership team and report directly to the General Counsel.

-Oversee and manage OPWDD's role as party in Medicaid Fair Hearings, including the preparation and review of written submissions for Medicaid Fair hearings as well as representing OPWDD at Medicaid Fair Hearings.

-Oversee and supervise a team of staff attorneys and legal assistants in tracking, preparing for and representing OPWDD at Medicaid Fair Hearings, gathering and preparing documents needed by non-legal staff representing and defending the actions of OPWDD's Regional Field Offices with respect to determinations involving OPWDD eligibility and supports and services.

-Develop and maintain policies and procedures detailing timelines, staff roles and responsibilities, template forms (including Notices of Determination) and letters necessary to prepare for hearings.

-Develop and maintain training documents for staff involved in hearings and will hold periodic training and informational sessions for applicable staff.
- Develop and maintain knowledge of OPWDD standards for eligibility for services, authorization for Medicaid HCBS and State Plan services, Care Coordination Organization/Health Home services, and any other subject matter necessary to support OPWDD's role in administrative hearings.

-Research and advise on issues related administrative due process.

-Provide support to the Attorney General, as needed.

-Perform other tasks as assigned by supervising Deputy Counsel or General Counsel.

Minimum Qualifications Preferred Qualifications:

Candidates must have been admitted to the New York State Bar and should have at least four (4) years of experience in the practice of law subsequent to admission to the Bar, including experience with supervising legal professionals.
