Duties Description The Deputy Counsel in the Bureau of Professional Medical Conduct is responsible for overseeing the day-to-day operations of the Bureau’s Albany Office, which would entail supervising six attorneys and two administrative support staff. The Deputy Counsel is responsible for ensuring the timely prosecution of cases; helping to establish Bureau policies and procedures and for implementing them; assigning and prioritizing Direct Referral and regular hearing cases and requests for assistance; supervising attorneys’ handling of all matters assigned them, including reviewing Statements of Charges, Disciplinary and Non-Disciplinary agreements, Post-Hearing Submissions, Summary Suspensions, Administrative Review Board appeals and court documents; providing legal advice and counsel and responding to requests for assistance from the OPMC Director and staff; reviewing Investigation Committee reports and participating in pre-Investigation Committee and Investigation Committee meetings; conducting performance evaluations; and performing various administrative tasks, such as reviewing and approving timesheets, travel requests, vacation requests, etc. that are incidental to being Deputy Counsel.

Minimum Qualifications Law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and six years of relevant post-bar experience.

Preferred Qualifications: The Bureau’s Deputy Counsel should have experience litigating complex cases, preferably physician misconduct administrative hearings and appeals. The Deputy Counsel should be knowledgeable about Public Health Law §230 and Education Law §6530, and should have excellent writing, communication, and organizational skills. Civil and/or criminal litigation experience would be beneficial. The Deputy Counsel needs to be able to handle multiple tasks efficiently and promptly and to interact appropriately with DOH administration, program staff, and other players.

Additional Comments *Salary Range from $127,507 - $160,911, commensurate with experience

This position is part of the NYS HELPS program. No examination is required.

This position may require travel throughout New York State including overnights to areas not served by public transportation.
